Latex Mattress - 25-Year Limited Warranty

The Limited Warranty begins on the date of delivery of your Peace Lily Latex Mattress from Peace Lily Sleep Pty Ltd ("Peace Lily"). Because we at Peace Lily believe in our Peace Lily Latex Mattress, and we want to provide our customers with high-quality, long-lasting products, we are hereby extending this twenty-five (25) year promise.

Peace Lily warrants the Latex Mattress against the defects in material and craftsmanship set forth below (“Defects”) for a period of 25 years from the moment your Latex Mattress is purchased by you when the Latex Mattress is used conventionally for its designated purposes on top of a proper bed frame.

If your Latex Mattress presents with a defect that is covered under this Latex Mattress Warranty, Peace Lily’s singular and unique liability (and your sole resolution under this Latex Mattress Warranty) will be, at Peace Lily’s option, to supply a replacement Latex Mattress, which is conditional on the fulfilment of your responsibilities as disclosed within this warranty.

In the event Peace Lily consents to replace the Latex Mattress you have purchased, the replacement will be of the identical version and size as the original Latex Mattress purchased. In no circumstance will a substitution model be utilised as a replacement, with the exception being in the case of a discontinued Latex Mattress. If this is the case, a Latex Mattress of similar construction, size and style will be used as a substitute for the deficient Latex Mattress, at the judgement of Peace Lily.

This warranty is subject to revision and change. Please retain a printout of this page for future reference.

What this Limited Warranty Covers:

Years 1-15 Full Coverage — Non-prorated

During the first fifteen (15) years of the Latex Mattress Warranty, Peace Lily will not charge the purchaser to repair or replace the purchaser’s Latex Mattress if it qualifies under the Latex Mattress Warranty. This period is non-prorated which means that Peace Lily does not charge a percentage of the repair costs or replacement product based on the amount of time you slept on the Latex Mattress prior to noticing a defect. Proof of direct, authorised purchase is required with all warranty claims. This warranty applies only to The Peace Lily Latex Mattress and is not extended to other products in the Peace Lily product line.

Years 16-25: Limited Coverage — Prorated

During years 16-25 of the Latex Mattress Warranty, Peace Lily will, at its option, replace the Latex Mattress at a prorated charge to the purchaser in addition to transportation and/or shipping charges. The prorated replacement charge will be dependent on the year that the Latex Mattress is replaced.

If the Latex Mattress is replaced during the sixteenth year, the prorated replacement charge the purchaser pays will be 50% of the original purchase price.

If the Latex Mattress is replaced after the sixteenth year but before the twenty-fifth year, the prorated replacement charge the purchaser pays will increase by 5% for each subsequent year of the prorated period (i.e. seventeenth year will be 55% of the original purchase price)

Your Responsibilities:

The Latex Mattress Warranty will start at the time the Latex Mattress is purchased by you and is utilised conventionally for its designated purposes on a slatted bed base frame that is structurally competent in supporting the weight of the Latex Mattress and user(s) and does not have a wet surface. The Latex Mattress is required to be on a bed base that is in the absence of treatment or polishes that can result in mould. The Latex Mattress must be used in a room that lacks moisture in order to prevent mould growth. The Latex Mattress must be kept away from direct sunlight and kept out of close proximity to any heating devices.

A proper bed frame is defined, as applicable to this Latex Mattress Warranty, as having at least four (4) leg supports for the Latex Mattress and being sturdy enough to support 100kg in Latex Mattress weight plus the total user weight. For all-size slatted style bed frames, there must not be more than nine (9) centimetres or three and a half (3.5) inches gap between each of the slats in order to ensure sufficient structural support for both the foundation and user(s). The slats are also required to be solid in their construction (flexible slats are not suitable to support the weight of the mattress, and as such do not qualify as a proper bed frame). To ensure the validity of your Latex Mattress Warranty, it is essential to promptly unseal and unroll the product within two (2) weeks of receiving it. Prolonged compression of the Mattress Topper may lead to structural damage and moisture accumulation. Therefore, timely unpackaging is recommended to maintain the integrity and performance of the product.

Peace Lily does not make any medical or health assertions in regard to its Latex Mattresses. Uneasiness, allergic reactions, or other similar conditions, are not covered under this Latex Mattress Warranty. A licensed physician should be consulted with any questions or concerns regarding health or medical conditions.

To maximise the lifespan of the Latex Mattress it is recommended that users rotate their Latex Mattress from head-to-toe, at least once every month within the first six months, then after this every other month for the life cycle of the Latex Mattress, to ensure that wear is evenly distributed.

In the case of a replacement Latex Mattress being required, Peace Lily may ask you to donate your used Latex Mattress to a charity in order to repurpose it for someone who is in need. In that event, you will be required to follow the instructions of Peace Lily and supply a written receipt or proof of return for discarding or donation of the original, deficient Latex Mattress, from a recognised organisation that is chosen. This Latex Mattress Warranty is not transmittable, meaning it is only valid for a Latex Mattress that was purchased from Peace Lily by the original purchaser.

Who This Limited Warranty Is Extended To:

This Limited Warranty extends to the initial, “original” purchaser of this product only and not to any possible future owner(s) of the product. For purposes of this Limited Warranty, an “original” purchaser is the individual or entity who purchased this Latex Mattress from Peace Lily directly or, as the case may be, from an authorised retailer, distributor or dealer.

Defects Covered Under The Latex Mattress Warranty:

Any clear and evident indentation that is equivalent to or more than two and a half (2.5) centimetres that is not connected with or stemming from a faulty, unsuitable or unsupportive foundation, box spring or platform that is not created or manufactured so that it has the capacity of handling the combined weight of the Latex Mattress and its intended users.

This indentation must be discernible to the naked eye when there is no weight used on the top of the Latex Mattress. If the purchaser utilises an incorrect foundation, box spring or base as definitively decided by Peace Lily, the Latex Mattress Warranty, without any limitation, will become invalid. It will be a requirement of the purchaser to supply appropriate proof of the condition of the foundation, box spring or base used to Peace Lily.

Any physical deficiency in the natural latex foam that results in it splitting or cracking under conditions of standard use and correct handling will be covered.

This Latex Mattress Warranty Does Not Cover:

Normal deterioration through use or any condition that is caused by mistreatment or abuse of the Latex Mattress or neglect in maintaining the Latex Mattress in a clean condition, free of stains and potentially unhygienic conditions.

Through normal usage, it is expected that an increase of softness is something that usually occurs.

A normal increase in softness due to normal usage.

Preference of comfort. Any representation of the level of comfort of any Latex Mattress is solely given as a recommendation and Peace Lily does not give assurances of the firmness or softness quality of any Latex Mattress, nor does it warrant that a particular comfort preference will be to your enjoyment.

Mould, smells, and/or stains as a result of irregular care including, but not limited to liquid spills, improper ventilation including, but not limited to humid climates and/or areas where the Latex Mattress is subjected to excessive water or humidity.

Damage that is the result of an unsuitable bed frame, foundation, box spring, or base as decided by Peace Lily.

Blemishes that do not restrict or hinder standard use and comfort of the Latex Mattress by a rational person are not regarded to be deficiencies. An example of this can be surfaces that may not be absolutely even, and corners that may not be impeccably shaped. You are not able to seek a remedy for deficiencies like these under this Latex Mattress Warranty.

More specifically, this Latex Mattress Warranty excludes:

(a) minor blemishes and small external flaws.
(b) normal deterioration through use.
(c) burns, marks, soiling, rips, and discolouration that can occur over time.
(d) mould or wetness.
(e) unique or individualised preferences relating to firmness, texture, and comfort.
(f) standard body indentations not greater than two and a half (2.5) centimetres in the Latex Mattress as measured below the quilt level — in other words, some settling of the fibre in the quilt should be anticipated and as such is not regarded as a defect.
(g) individual or personalised allergies and reactiveness.
(h) odours that are naturally present in wool, cotton, or latex foams.
(i) as a result of the essence of the fabric, the organic cover may give the impression of stretching slightly.

Additionally, this Latex Mattress Warranty does not cover conditions stemming from mistreatment, improper use, or disrepair. Appropriately, the following conditions, if found upon further inspection, will invalidate your Warranty:

(a) Any unhygienic condition.
(b) Burns.
(c) Utilising the product on an unsuitable bed frame.
(d) Using our Latex Mattress directly on the floor.
(e) Physically mistreating the Latex Mattress.
(f) Attempting to clean the Latex Mattress incorrectly.
(g) Incorrect storage of the Latex Mattress (comprising storage in moist areas, places overrun with insects or rodents, not stored in a folded position or in any other unguarded storage areas).
(h) Purchase from other merchants who are not legitimate retailers.

Peace Lily shall not be liable for incidental or consequential damages resulting from the use of this product or arising out of any breach of this limited warranty; the exclusive remedy for breach of this warranty shall be replacement or credit towards replacement as set forth herein. There are no express or implied warranties, including implied warranties of merchantability and fitness for a particular purpose, other than the warranty described on the face of this limited warranty. In any case, the extent of liability on the part of Peace Lily will be limited to that of the purchase price of the product.

All parts of this limited warranty apply to the maximum extent permitted by law or unless prohibited by law. This limited warranty gives the purchaser specific legal rights, and the purchaser may also have other rights, which may vary from state to state.

How To File A Claim Under This Warranty:

To file a claim under the terms of this Limited Warranty, please contact Peace Lily by emailing us at info@peacelily.com.au. Please have your proof of purchase documentation ready and available. In the event that a warranty claim is filed and a product replacement is deemed necessary, the purchaser must surrender the original product as per Peace Lily’s donation or disposal recommendations.

In the event that you, the purchaser, make a claim under this Limited Warranty, Peace Lily will assess the Latex Mattress first, If deemed faulty, within thirty days, Peace Lily will repair or replace the Latex Mattress, if it is found to abide by the Warranty conditions and be defective. Peace Lily will pay for shipping costs associated with the replacement product to the original purchaser.

You Must Also Provide:

Substantial original proof of purchase that shows the date of purchase and that the claimant is the original consumer and still has the Latex Mattress.

You will be required to send in full-length photos which need to include a brief narrative describing the defect and how it is affecting the performance of the Latex Mattress.

Please send all the necessary evidence to info@peacelily.com.au. You are accountable for presenting your claim with the required supporting documentation that is adequate for Peace Lily to provide a resolution if required. Peace Lily retains the right, in Peace Lily's singular disposition, to necessitate photographs, additional information or explanations prior to agreeing to your claim according to this Latex Mattress Warranty. Your Latex Mattress Warranty can become invalid if you decline to collaborate with an investigation, provide satisfactory answers to requests, or comply with any provision of this Latex Mattress Warranty.

The operational area for all Peace Lily products is addressed within all states of Australia only. If your Peace Lily product is located beyond Australia, you are accountable for any costs attributed to pick-up or donation.

Disclaimer (Limitations On Liability):

To the maximum extent permitted by applicable law, Peace Lily and its authorised resellers, distributors, and/or suppliers make no representations, warranties or conditions, express or implied, beyond those outlined in this warranty and non-puffery claims in Peace Lily marketing materials. each of those parties disclaims any and all warranties or conditions, express, statutory and implied. Some jurisdictions do not allow the limitation or exclusion of certain warranties or conditions, so some of the above exclusions may not apply to you. There are no warranties that extend beyond the face of this document.

In no event will Peace Lily or its resellers, distributors, and/or suppliers be liable for any damages, including without limitation any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from your or any third party’s purchase and/or use of the product, even if Peace Lily or such other party has been advised of the possibility of such damages. These limitations and exclusions apply without regard to whether the damages arise from

(1) breach of contract
(2) breach of warranty
(3) negligence
(4) any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law.

Some jurisdictions do not allow the limitation or exclusion of certain damages, warranties or conditions, so some of the above limitations may not apply to you. In no case shall Peace Lily’s liability exceed the purchase price paid for the Latex Mattress giving rise to any such liability.

Arbitration:

If a dispute arises between you and Peace Lily arising out of or relating to this Latex Mattress Warranty, that dispute will be resolved in accordance with the general dispute resolution provisions of the Peace Lily terms of service. The arbitration conducted pursuant to this provision will be deemed final and binding and will not be subject to appeal absent extraordinary circumstances.

As in all other dispute situations under the Peace Lily terms of service, an arbitration concerning a dispute arising out of or relating to the Latex Mattress Warranty will not be combined with any other proceeding or arbitration against one of the parties. In addition, to the maximum extent permitted by applicable law, you will only be permitted to assert your own claim, and may not appear as a representative of the interests of any other person, entity or class of consumers (including a private attorney general or otherwise).

Governing Law:

This Limited Latex Mattress Warranty will be governed by the laws of Australia.

Hybrid Mattress - 15-Year Limited Warranty

The Limited Warranty begins on the date of delivery of your Peace Lily Hybrid Mattress from Peace Lily Sleep Pty Ltd ("Peace Lily"). Because we at Peace Lily believe in our Peace Lily Hybrid Mattress, and we want to provide our customers with high-quality, long-lasting products, we are hereby extending this fifteen (15) year promise.

Peace Lily warrants the Hybrid Mattress against the defects in material and workmanship set forth below (“Defects”) for a period of 15 years from the time your Hybrid Mattress is purchased by you when the Hybrid Mattress is used normally for its intended purposes on top of a proper bed frame.

If your Hybrid Mattress has a defect covered under this Hybrid Mattress Warranty, Peace Lily’s sole and exclusive liability (and your sole remedy under this Hybrid Mattress Warranty) will be, at Peace Lily’s option, to provide a replacement Hybrid Mattress, subject to the fulfilment of your obligations as set forth herein.

In the event Peace Lily chooses to replace the Hybrid Mattress, the replacement will be of the same model and size as the original Hybrid Mattress purchased. In no event will a substitution model be used as a replacement except in the case of a discontinued Hybrid Mattress, in this event a Hybrid Mattress of like build, size and design, at Peace Lily's discretion will be used as a replacement for the defective Hybrid Mattress.

If the Hybrid Mattress is replaced during the eleventh year, the prorated replacement charge the purchaser pays will be 50% of the original purchase price.

If the Hybrid Mattress is replaced after the eleventh year but before the fifteenth year, the prorated replacement charge the purchaser pays will increase by 10% for each subsequent year of the prorated period (i.e. 60% of the original purchase price)

Peace Lily makes no medical or health claims regarding its Hybrid Mattresses. Allergies, discomfort, or other conditions, are not covered under this Hybrid Mattress Warranty. Any questions or concerns regarding medical or health conditions should be addressed by a licensed physician.

This Hybrid Mattress Warranty is not transferable and applies only to a mattress purchased from Peace Lily by the original purchaser.

Who This Limited Warranty Is Extended To:

This Limited Warranty extends to the initial, “original” purchaser of this product only and not to any possible future owner(s) of the product. For purposes of this Limited Warranty, an “original” purchaser is the individual or entity who purchased this mattress from Peace Lily directly or, as the case may be, from an authorised retailer, distributor or dealer.

Defects Covered Under The Hybrid Mattress Warranty:

Any visible indentation is equal or greater than two and a half (2.5) centimetres that is not associated with or resulting from a faulty, improper or unsupportive foundation, box spring or platform that is not designed or constructed so that it is capable of handling the combined weight of the Hybrid Mattress and its intended users.

The indentation must be visible to the naked eye when no weight is applied to the top of the Hybrid Mattress. If the purchaser uses an inappropriate foundation, box spring or base as determined by Peace Lily, the Hybrid Mattress Warranty, without limitation, will be void. Peace Lily will require the purchaser to provide proof of the quality of the foundation, box spring or base used.

Any physical flaw in the natural latex foam that causes it to split or crack under conditions of normal use and proper handling will be covered.

This Hybrid Mattress Warranty Does Not Cover:

Normal wear and tear or any condition resulting from misuse or abuse of the Hybrid Mattress or failure to keep the Hybrid Mattress clean and free of stains and potentially unsanitary conditions.

A normal increase in softness due to normal usage.

Comfort preference. Any comfort level description of any Hybrid Mattress is solely provided as a guideline and Peace Lily does not guarantee the firmness or softness quality of any Hybrid Mattress, nor does it warrant that a particular comfort preference will be to your liking.

Mould, odours, and/or discolouration caused by abnormal care including, but not limited to liquid spills, improper ventilation including, but not limited to humid climates and/or areas where the Hybrid Mattress is exposed to excessive water or humidity.

Damage associated with an improper bed frame, foundation, box spring, or base as determined by Peace Lily.

Imperfections that do not prevent ordinary use and enjoyment of the Hybrid Mattress by a reasonable person are not considered to be defects. For example, surfaces may not be perfectly even, and corners may not be perfectly shaped or symmetrical. These are not defects for which you can seek a remedy under this Hybrid Mattress Warranty.

More specifically, this Hybrid Mattress Warranty excludes:

(a) minor imperfections and slight cosmetic flaws.
(b) normal wear and tear.
(c) tears, stains, soiling, burns, and discolouration that occur over time.
(d) dampness or mould.
(e) individual or personalised preferences relating to firmness, texture, and comfort.
(f) normal body impressions not greater than two and a half (2.5) centimetres in the Hybrid Mattress as measured below the quilt level — in other words, some settling of the fibre in the quilt should be expected and is not considered a defect).
(g) individual or personalised allergies and sensitivities.
(h) naturally occurring cotton, wool, or latex foam aromas.
(i) due to the nature of the fabric, the organic cover may appear to stretch slightly.

In addition, this Hybrid Mattress Warranty does not cover conditions resulting from abusive handling, misuse, or neglect. Accordingly, the following circumstances, if discovered upon inspection, will void your Warranty:

(a) Any unsanitary condition.
(b) Burns.
(c) Use of the product on an improper bed frame.
(d) Using our Hybrid Mattress directly on the floor.
(e) Physically abusing the Hybrid Mattress.
(f) Attempting to clean the Hybrid Mattress inappropriately.
(g) Improper storage of the Hybrid Mattress (including storage in damp locations, areas infested with insects or rodents, do not store folded or in any other unprotected storage areas).
(h) Purchase from resellers who are not authorised retailers.

How To File A Claim Under This Warranty:

In the event that you, the purchaser, make a claim under this Limited Warranty, Peace Lily will assess the mattress first, If deemed faulty, within thirty days, Peace Lily will repair or replace the mattress, if it is found to abide by the Warranty conditions and be defective. Peace Lily will pay for shipping costs associated with the replacement product to the original purchaser.

You Must Also Provide:

Valid original proof of purchase demonstrating the date of purchase and that the claimant is the original purchaser and still has the Hybrid Mattress.

You will be required to send in full-length photos which need to include a brief narrative describing the defect and how it is affecting the performance of the Hybrid Mattress.

Please send all requested documentation to info@peacelily.com.au. You are responsible for submitting your claim with sufficient supporting documentation for Peace Lily to provide a remedy if necessary. Peace Lily reserves the right, in Peace Lily's sole discretion, to require photographs, further information or descriptions prior to accepting your claim under this Hybrid Mattress Warranty. Your Mattress Warranty may be voided if you refuse to cooperate with an investigation, provide adequate responses to requests, or comply with any provision of this Hybrid Mattress Warranty.

The serviceable area for all Peace Lily products is addressed within all states of Australia only. If your Peace Lily product is located outside of Australia, you are responsible for any costs associated with pick-up or donation.

Mattress Topper - 10-year limited warranty

The Limited Warranty begins on the date of delivery of your Peace Lily Mattress Topper from Peace Lily Sleep Pty Ltd ("Peace Lily"). Because we at Peace Lily believe in our Peace Lily Mattress Toppers, and we want to provide our customers with high-quality, long-lasting products, we are hereby extending this ten-year (10) year promise.

Peace Lily warrants the Mattress Topper against the defects in material and craftsmanship set forth below (“Defects”) for a period of 10 years from the moment your Mattress Topper is purchased by you when using the Mattress Topper for its designated purposes on top of an existing mattress.

If your Mattress Topper presents with a defect covered under this Mattress Topper Warranty, Peace Lily’s singular and unique responsibility (and your sole resolution under this Mattress Topper Warranty) will be, at Peace Lily’s option, to supply a replacement Mattress Topper, which is conditional on the fulfilment of your responsibilities as disclosed within this warranty.

In the event Peace Lily consents to replace the Mattress Topper you have purchased, the replacement will be of the identical version and size as the original Mattress Topper purchased. In no circumstance will a substitution model be utilised as a replacement,with the exception being in the case of a discontinued Mattress Topper. If this is the case a Mattress Topper of similar construction, size and style will be used as a substitute for the deficient Mattress Topper, at the judgement of Peace Lily.

What this Limited Warranty Covers:

Years 1-5: Full Coverage — Non-prorated

During the first five years of the Mattress Topper Warranty, Peace Lily will not charge the purchaser to repair or replace the purchaser’s Mattress Topper if it qualifies under the Mattress Topper Warranty. This period is non-prorated which means that Peace Lily does not charge a percentage of the repair costs or replacement product based on the amount of time you slept on the Mattress Topper prior to noticing a defect.

Years 6-10: Limited Coverage — Prorated

During years 6-10 of this Mattress Topper Warranty, Peace Lily will, at its option, replace the Mattress Topper at a prorated charge to the purchaser plus transportation and/or shipping charges. The prorated replacement charge will be dependent on the year that the Mattress Topper is replaced.

If the Mattress Topper is replaced during the sixth year, the prorated replacement charge the purchaser pays will be 50% of the original purchase price. If the Mattress Topper is replaced after the seventh year, the prorated replacement charge the purchaser pays will increase by 10% for each subsequent year of the prorated period. If the Mattress Topper is replaced in year ten or any point after that prior to the expiration of the Mattress Topper Warranty the prorated replacement charge will be 90% of the original purchase price.

The replacement will be of the same model and size as the original Mattress Topper purchased. In no event will a substitution model be used as a replacement except in the case of a discontinued Mattress Topper. In this event, a Mattress Topper of like build and design, at Peace Lily's discretion, will be used as a replacement for the defective Mattress Topper. Replaced or repaired Mattress Toppers are subject to the same Mattress Topper Warranty as the original Mattress Topper. If you obtain a replaced or repaired Mattress Topper, the warranty term of the replaced or repaired Mattress Topper begins from the date of purchase of the original Mattress Topper.

Your Responsibilities:

The Mattress Topper Warranty will start at the time the Mattress Topper is purchased by you and is utilised conventionally for its designated purposes and on a mattress that is structurally competent in supporting the Mattress Topper and user(s). The Mattress Topper must be kept away from direct sunlight and avoid the close proximity to any heating devices.

To ensure the validity of your Mattress Topper Warranty, it is essential to promptly unseal and unroll the product within two (2) weeks of receiving it. Prolonged compression of the Mattress Topper may lead to structural damage and moisture accumulation. Therefore, timely unpackaging is recommended to maintain the integrity and performance of the product.

Peace Lily does not make any medical or health assertions in regard to its Mattress Toppers. Uneasiness, allergic reactions, or other similar conditions, are not covered under this Mattress Topper Warranty. A licensed physician should be consulted with any questions or concerns regarding health or medical conditions.

To maximise the lifespan of the Mattress Topper it is recommended that users rotate or flip their Mattress Topper from head-to-toe, at least once every month within the first six months, then after this every other month for the life cycle of their Mattress Topper to ensure that wear is evenly distributed.

In the case of a replacement Mattress Topper being required, Peace Lily will ask you to donate your used Mattress Topper to a charity in order to repurpose the Mattress Topper for someone who is in need. In that event, you will be required to follow the instructions of Peace Lily and supply a written receipt or proof of return for discarding or donation of the original, deficient Mattress Topper, from a recognised organisation that is chosen, before any replacement Mattress Topper or reimbursements will be issued. This Mattress Topper Warranty is not transmittable, meaning it is only valid for a Mattress Topper that was purchased from Peace Lily by the original purchaser.

Who This Limited Warranty Is Extended To:

This Limited Warranty extends to the initial, “original” purchaser of this product only and not to any possible future owner(s) of the product. For purposes of this Limited Warranty, an “original” purchaser is the individual or entity who purchased this Mattress Topper from Peace Lily directly or, as the case may be, from an authorised retailer, distributor or dealer.

Defects Covered Under The Mattress Topper Warranty:

Any clear and evident indentation that is equivalent to or more than two and five (2.5) centimetres that is not connected with or stemming from faulty or incorrect usage.

This indentation must be discernible to the naked eye when there is no weight used on the top of the Mattress Topper. In the event that the purchaser utilises an incorrect foundation, floor or mattress as definitively decided by Peace Lily, the Mattress topper Warranty, without any limitation, will be invalid. It will be a requirement of the purchaser to supply appropriate proof of the condition of the foundation or mattress used to Peace Lily.

Any physical deficiency in the natural latex foam that results in it splitting or cracking under conditions of standard use and correct handling will also be covered.

This Mattress Topper Warranty Does Not Cover:

Normal deterioration through use or any condition that is caused by mistreatment or abuse of the Mattress Topper or neglect in maintaining the Mattress Topper in a clean condition, free of stains and potentially unhygienic conditions.

Through normal usage, it is expected that an increase in softness is something that can occur.

Preference of comfort. Any representation of the comfort of any Mattress Topper is solely given as a recommendation and Peace Lily does not give assurances of the firmness or softness quality of any Mattress Topper, nor does it warrant that a particular comfort preference will be to your enjoyment.

Physical mistreatment or damage to the structure and/or materials, including, but not limited to burns, lacerations, rips, and/or liquid damage.

Mould, smells, and/or stains as a result of irregular care including, but not limited to liquid spills, inadequate ventilation, including, but not limited to humid climates and/or areas where the Mattress Topper is subjected to excessive water or humidity.

Damage that is caused by using the Mattress Topper on any other surface other than an existing mattress.

Blemishes that do not restrict or hinder standard use and comfort of the Mattress Topper by a rational person are not regarded to be deficiencies. An example of this can be surfaces that may not be perfectly even, and corners that may not be impeccably shaped. You are not able to seek a remedy for deficiencies like these under this Mattress Topper Warranty.

More accurately, this Mattress Topper Warranty excludes:

(a) minor blemishes and small external flaws.
(b) normal deterioration through use.
(c) burns, marks, soiling, rips, and discolouration that can occur over time.
(d) mould or wetness.
(e) unique or individualised preferences relating to firmness, texture and comfort.
(f) standard body indentations not greater than two and a half (2.5) centimetres in the Mattress Topper as measured below the quilt level – in other words, some settling of the fibre in the quilt should be anticipated and as such is not regarded as a defect).
(g) individual or personalised allergies and reactiveness.
(h) odours that are naturally present in wool, cotton, or latex foam.
(i) as a result of the essence of the fabric, the organic cover may give the impression of stretching slightly.

Additionally, this Mattress Topper Warranty does not cover conditions stemming from mistreatment, improper use, or disrepair. Appropriately, the following conditions, if found upon further inspection, will invalidate your Mattress Topper Warranty:

(a) any unhygienic condition.
(b) burns.
(c) utilising the Mattress Topper on any additional surface other than an existing mattress.
(d) using our Mattress Topper without a mattress.
(e) physically mistreating the Mattress Topper.
(f) attempting to clean the Mattress Topper in an incorrect manner.
(g) incorrect storage of the Mattress Topper (comprising storage in moist areas, places overrun with insects or rodents, or any other unguarded storage areas).
(h) Purchase from other merchants who are not legitimate retailers.

How To File A Claim Under This Warranty

In the event that you, the purchaser, make a claim under this Limited Warranty, Peace Lily will assess the Mattress Topper first, If deemed faulty, within thirty days, Peace Lily will repair or replace the Mattress Topper, if it is found to be abiding by the Warranty conditions and be defective. Peace Lily will pay for shipping costs associated with the replacement product to the original purchaser.

You Must Also Provide:

Substantial original proof of purchase that shows the date of purchase and that the claimant is the original consumer and still has the Mattress Topper.

You will be required to send in full-length photos which need to include a brief narrative describing the defect and how it is affecting the performance of the Mattress Topper.

You are accountable for presenting your claim with the required supporting documentation that is adequate for Peace Lily to provide a resolution if required. Arbitration:

If a dispute arises between you and Peace Lily arising out of or relating to this Bed Sheet Set Warranty, that dispute will be resolved in accordance with the general dispute resolution provisions of the Peace Lily terms of service. The arbitration conducted pursuant to this provision will be deemed final and binding and will not be subject to appeal absent extraordinary circumstances.

As in all other dispute situations under the Peace Lily terms of service, an arbitration concerning a dispute arising out of or relating to the Bed Sheet Set Warranty will not be combined with any other proceeding or arbitration against one of the parties. In addition, to the maximum extent permitted by applicable law, you will only be permitted to assert your own claim, and may not appear as a representative of the interests of any other person, entity or class of consumers (including a private attorney general or otherwise).

Adjustable Bed – Limited Warranty

The Limited Warranty begins on the date of purchase of a Peace Lily Adjustable Bed from Peace Lily Sleep Pty Ltd ("Peace Lily"). This Limited Warranty extends only to the original Purchaser of a new and unused Peace Lily Adjustable Bed and may not be transferred. If original proof of purchase is not provided by Purchaser, Peace Lily reserves the right to determine if the Adjustable Bed is covered by this Limited Warranty. This warranty is subject to revision and change.

The Limited Warranty begins on the date of delivery of your Peace Lily Adjustable Bed from Peace Lily Sleep Pty Ltd ("Peace Lily"). Because we at Peace Lily believe in our Peace Lily adjustable bed, and we want to provide our customers with high-quality, long-lasting products, we are hereby extending this two--, five- and ten-year promise.

Your new Peace Lily Adjustable Bed (the “Adjustable Bed”) is covered by a 2, 5 or 10-year limited warranty (the “Adjustable Bed Warranty”). The duration of your warranty is selected at the time of purchase. Peace Lily warrants the Adjustable Bed against the defects in material and workmanship set forth below (“Defects”) for your selected warranty duration from the time your Adjustable Bed is purchased by you when the Adjustable Bed is used normally for its intended purposes together with an existing mattress.

Peace Lily warrants to the end user during the term of this Limited Warranty, Peace Lily will repair or replace any Peace Lily Adjustable Bed from the original owner should it be defective due to faulty workmanship or structural defects, at Peace Lily’s discretion and subject to the limitations and conditions described in this warranty.

In the event Peace Lily chooses to replace the Adjustable Bed, the replacement will be of the same model and size as the original Adjustable Bed purchased. In no event will a substitution model be used as a replacement except in the case of a discontinued Adjustable Bed, in this event an Adjustable Bed of like build and design, at Peace Lily's discretion will be used as a replacement for the defective Adjustable Bed.

Warranty Full Two, Five Or Ten Year (Parts, Labour & Freight):

During your warranty period and beginning from the date of purchase, the Peace Lily Adjustable Bed is warranted against non-excluded defects in Peace Lily’s workmanship or materials. During the period of your warranty and starting from the Warranty Commencement Date, Peace Lily will repair or replace (at no cost to Purchaser) any defective Adjustable Bed part, and Peace Lily will pay all Parts, authorised labour and transportation costs associated with the repair or replacement of any parts found to be defective. This replacement under warranty shall be effective only if the defective part is returned at the instruction of Peace Lily.

Limited Lifetime Warranty Applies To The Steel Frame And Mechanical Base Parts Only.

Upon notice and from the Warranty Commencement Date through the product lifetime, Peace Lily will replace, (upon terms and conditions set forth in this paragraph), the steel and mechanical base parts found to be defective and not excluded by this warranty.

This limited lifetime warranty does not cover any electronics, electrical components, drive motors or massage motors. The purchaser is responsible for paying all service and transportation costs related to the receiving and installation of the new part.

This limited lifetime warranty shall be effective only if the defective part is returned to Peace Lily.

Your Responsibilities:

The Adjustable Bed Warranty begins at the time the Adjustable Bed is purchased by you when the Adjustable Bed is used normally for its intended purposes.

A minimum of 2 able and fit adults should be used when lifting or moving the beds. It is recommended to use trolleys or other lifting/moving devices where possible.
Careless use of naked flames, cigarettes or other heat sources could set fire to this product.
Do not allow children to play on or around the adjustable bed.
Do not operate whilst any person is under the base whilst raising/ lowering or adjusting the bed.
Care should be taken so that no body parts are in or near the adjustable frame while operating.
Do not rock or tilt the frame.
Ensure the cabling of the bed is free from the mechanism.
Do not run over electric cables when moving the bed.
The Adjustable Bed needs to be positioned carefully away from power points to reduce the risk of the bed damaging power points, plugs and cabling.
Do not manipulate or conduct electrical maintenance on the motors or any of the beds, electrical components or cables.
Any electrical work must be facilitated by a qualified tradesperson.
Legs and screws should be checked for tightness regularly.
When transporting- Do not over-tighten when restraining.
Maximum recommended weight limits: 350 KG
Do not jump on or abuse the bed.
Beds should be positioned with clearance from the wall and other objects to avoid damage.
Use the controller only for adjusting the bed frame for intended use- not for entertainment.
Lubricate any moving parts, using a non-corrosive lubricant every 12 months or as required. We recommend the use of INOX.

Who This Limited Warranty Is Extended To:

This Limited Warranty extends to the initial, “original” purchaser of this product only and not to any possible future owner(s) of the product. For purposes of this Limited Warranty, an “original” purchaser is the individual or entity who purchased this mattress from Peace Lily directly or, as the case may be, from an authorised retailer, distributor or dealer.

This Adjustable Bed Warranty Does Not Cover:

This warranty does not apply:

(a) to any damage caused by the Purchaser.
(b) if there has been any repair or replacement of adjustable bed base parts by an unauthorised person.
(c) if the adjustable bed base has been mishandled (whether in transit or by other means), subjected to physical or electrical abuse or misuse, or otherwise operated in any manner inconsistent with the operation and maintenance procedures outlined in the Owner’s Manual and this warranty.
(d) to damage to mattresses, fabric, cables, electrical cords or items supplied by others (contact those parties for warranty information on these items).
(e) if there has been any modification of the adjustable bed base without prior written consent by Peace Lily.
(f) to costs for unnecessary service calls, including costs for in-home service calls solely for the purpose of educating you about the adjustable bed base or finding a satisfactory power connection.
(g) fabric (including stains, soiling, burns and normal wear).
(h) items on inspection that are deemed unsanitary.
(i) failure to comply with manufacturer care and maintenance instructions.

This warranty will be void if either the recommended weight restriction is not followed (refer to the advisory section of the Owner’s Manual) or if you sell, give or transfer the bed base to another person. Any repairs to or replacement of the Peace Lily Adjustable Bed or its components under the terms of this limited warranty does not extend the applicable warranty time from the Warranty Commencement Date. The decision to repair or replace defective parts under this warranty shall be made at the sole discretion of Peace Lily.

Repair or replacement shall be the sole remedy of the Purchaser. There shall be no liability on the part of Peace Lily for any special, indirect, incidental, or consequential damages or for any other damage, claim, or loss not expressly covered by the terms of this warranty. This limited warranty does not include reimbursement for inconvenience, removal, installation, setup time, loss of use, shipping, or any other costs or expenses. Peace Lily and its service technicians will not be responsible for moving furniture or any other items not attached to the Peace Lily Adjustable Bed to perform service on the Peace Lily Adjustable Bed. It is the sole responsibility of the Purchaser to provide adequate space and accessibility to the Peace Lily Adjustable Bed. If the technician is unable to perform service due to lack of accessibility, the service call will be billed to you and the service will be rescheduled.

If the Adjustable Bed incurs a problem that is not due to a manufacturing fault, a service and repair charge will become payable by the customers to service or repair the Adjustable Bed, prior to the service call taking place. If the repair is found to be a warranty claim, then the charge will be refunded in full, after the service call within 3 - 5 business days to a nominated bank account

Peace Lily makes no other warranty whatsoever, express or implied, and all implied warranties or merchantability and fitness for a purpose are disclaimed by Peace Lily and excluded from this agreement.

How To File A Claim Under This Warranty

In the event that you, the purchaser, make a claim under this Limited Warranty, Peace Lily will assess the Adjustable Bed first, If deemed faulty, within thirty days, Peace Lily will repair or replace the Adjustable Bed, if it is found to abide by the Warranty conditions and be defective. Peace Lily will pay for shipping costs associated with the replacement product to the original purchaser.

You Must Also Provide:

Valid original proof of purchase demonstrating the date of purchase and that the claimant is the original purchaser and still has the Adjustable Bed.

You will be required to send in full-length photos which need to include a brief narrative describing the defect and how it is affecting the performance of the Adjustable Bed.

Please send all requested documentation to info@peacelily.com.au. You are responsible for submitting your claim with sufficient supporting documentation for Peace Lily to provide a remedy if necessary. Peace Lily reserves the right, in Peace Lily's sole discretion, to require photographs, further information or descriptions, prior to accepting your claim under this Adjustable Bed Warranty. Your Adjustable Bed Warranty may be voided if you refuse to cooperate with an investigation, provide adequate responses to requests, or comply with any provision of this Adjustable Bed Warranty.

To the maximum extent permitted by applicable law, Peace Lily and its authorised resellers, distributors, and/or suppliers make no representations, warranties or conditions, express or implied, beyond those set forth in this warranty and non-puffery claims in Peace Lily marketing materials. each of those parties disclaims any and all warranties or conditions, express, statutory and implied. Some jurisdictions do not allow the limitation or exclusion of certain warranties or conditions, so some of the above exclusions may not apply to you. There are no warranties that extend beyond the face of this document.
